Welcome to The Singhal Heritage House.

The terms “we,” “us,” and “our” refer to The Singhal Heritage House. We operate this website and online store, including all related information, content, features, tools, products, and services offered through the website collectively referred to as the “Services.”

Our online store is hosted and powered by Shopify, which provides the e-commerce platform that enables us to offer our products and Services to you.

These Terms of Service, together with all policies referenced in them, explain your rights and responsibilities when accessing or using our Services.

By visiting our website, creating an account, placing an order, or otherwise using the Services, you agree to these Terms of Service and our:

  • Privacy Policy;
  • Return and Refund Policy;
  • Shipping Policy; and
  • Any other policies posted on our website.

Our policies can be accessed through the policy links provided on our website and during checkout.

If you do not agree with these Terms, you must not access or use the Services.

By using the Services, you represent that you are at least the age of majority in your state, province, or country of residence, or that you are using the Services with the permission and supervision of a parent or legal guardian.

SECTION 2 — PRODUCTS AND PRODUCT INFORMATION

We make reasonable efforts to describe and display our products accurately. However, colors, appearance, size, texture, and packaging may vary depending on your device, screen settings, photography, lighting, and product batch.

Many of our products are handmade or prepared in small batches. Minor variations in color, texture, wax appearance, label positioning, decoration, fragrance intensity, or finish may occur and are not necessarily considered defects.

Product descriptions, scent notes, usage duration, burn time, fragrance strength, and similar information are estimates based on ordinary use. Actual performance may vary because of temperature, ventilation, room or vehicle size, storage, maintenance, usage frequency, skin chemistry, and other conditions.

Fragrance perception is subjective. We do not guarantee that every customer will perceive or experience a fragrance in the same manner.

We reserve the right, without prior notice, to:

  • Change product descriptions, packaging, ingredients, or presentation;
  • Correct errors or inaccuracies;
  • Limit available quantities;
  • Discontinue products;
  • Restrict sales to certain customers, regions, or jurisdictions; and
  • Refuse orders where permitted by law.

Nothing in this section limits any mandatory legal rights relating to defective, unsafe, or materially misdescribed products.


SECTION 3 — PRODUCT SAFETY AND CUSTOMER RESPONSIBILITY

Customers must read and follow all warnings, labels, instructions, and safety information supplied with our products.

Candles, wax products, fragrance oils, perfumes, room sprays, car sprays, car fresheners, reed diffusers, and related fragrance products must be used only for their intended purpose.

Customers are responsible for:

  • Keeping products away from children and pets;
  • Avoiding direct contact with eyes or ingestion;
  • Keeping flammable products away from flames, sparks, and excessive heat;
  • Using candles only on stable, heat-resistant surfaces;
  • Never leaving a burning candle unattended;
  • Following wick-trimming and burn-time instructions;
  • Avoiding placement of fragrance liquids directly on painted, plastic, leather, fabric, wood, dashboard, or other sensitive surfaces;
  • Discontinuing use if irritation or an adverse reaction occurs; and
  • Consulting an appropriate medical professional concerning allergies, sensitivities, pregnancy, or health-related concerns.

Our products are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Statements concerning mood, relaxation, comfort, freshness, or fragrance experience are general descriptive statements and are not medical claims.


SECTION 4 — ORDERS AND ORDER ACCEPTANCE

Submitting an order constitutes an offer to purchase products from us.

An order is not considered accepted until:

  • Payment authorization has been successfully processed;
  • We confirm the order; and
  • We have not otherwise cancelled or declined the transaction.

We reserve the right to accept, reject, limit, or cancel an order for reasons including:

  • Product unavailability;
  • Pricing or listing errors;
  • Suspected fraud;
  • Payment authorization issues;
  • Incorrect customer information;
  • Resale activity;
  • Shipping restrictions;
  • Safety concerns; or
  • Violation of these Terms.

If we cancel an order after payment has been collected, we will issue an appropriate refund to the original payment method.

Please review your order carefully before submitting it. Cancellation requests are not guaranteed after processing, production, packing, or fulfillment has begun.

All returns and refunds are governed by our Return and Refund Policy.

Unless we expressly agree otherwise in writing, products purchased through our consumer store are intended for personal or household use and not for unauthorized resale, commercial redistribution, or export.


SECTION 5 — PRICES, PAYMENTS, TAXES, AND BILLING

All prices are displayed in the currency shown on the website at the time of purchase.

Prices, discounts, promotions, bundles, and product availability may change without prior notice. The price charged will generally be the price displayed when the order is submitted, subject to correction of obvious errors.

Unless expressly stated otherwise, product prices do not include:

  • Sales tax;
  • Shipping charges;
  • Handling charges;
  • Customs duties;
  • Import taxes;
  • Brokerage charges; or
  • Other government-imposed fees.

Customers are responsible for providing accurate billing and payment information and for ensuring they are authorized to use the selected payment method.

You agree to pay all charges associated with your order, including applicable taxes and shipping charges.

If a pricing or product-information error occurs, we may:

  • Contact you for confirmation;
  • Correct the order;
  • Cancel the affected item; or
  • Cancel and refund the order.

Promotional offers may be subject to separate terms. Where promotion-specific terms conflict with these Terms, the promotion-specific terms will apply to that promotion.


SECTION 6 — SHIPPING, DELIVERY, AND DELAYS

Shipping and delivery dates are estimates unless expressly stated otherwise.

We will make reasonable efforts to process and ship orders within the timeframe stated on our website or order confirmation.

We are not responsible for delays caused by circumstances reasonably outside our control, including:

  • Carrier delays;
  • Severe weather;
  • Natural disasters;
  • Labor interruptions;
  • Customs processing;
  • Government action;
  • Incorrect or incomplete addresses;
  • High-volume periods;
  • Supply interruptions; or
  • Other events beyond our reasonable control.

However, if we cannot ship an order within the promised timeframe, or within the legally applicable period when no specific timeframe was promised, we will take any actions required by applicable law, which may include notifying the customer, requesting consent to a delay, or cancelling and refunding the unshipped order. Federal rules generally require online sellers to have a reasonable basis for promised shipping times and to offer cancellation and a refund when a qualifying delay occurs.

Customers are responsible for providing a complete and accurate delivery address.

We are not responsible for delivery issues caused by:

  • Incorrect or incomplete addresses;
  • Refused delivery;
  • Failure to collect a package;
  • Restricted carrier access;
  • Unsecured delivery locations; or
  • Failure to respond to carrier notices.

Ownership and risk of loss will transfer as provided by applicable law. Nothing in these Terms removes rights or remedies that cannot legally be waived.

Claims involving lost, damaged, missing, stolen, or incorrectly delivered packages will be reviewed under our Shipping Policy and Return and Refund Policy.


SECTION 7 — RETURNS, REFUNDS, AND CANCELLATIONS

Eligible returns and refunds are governed exclusively by our published Return and Refund Policy.

Our current return-request period is generally 15 calendar days after delivery, subject to eligibility requirements and exclusions stated in that policy.

Opened, used, sprayed, burned, melted, tested, unsealed, personalized, custom-made, hygiene-sensitive, or final-sale products may not qualify for return, except where applicable law provides otherwise or where the item is damaged, defective, incorrect, or materially misdescribed.

Georgia businesses may establish their own return policies, but they are expected to honor the policies they publish.

Where there is any conflict between this section and our Return and Refund Policy, the more specific Return and Refund Policy will govern, subject to applicable law.


SECTION 8 — PROMOTIONS, DISCOUNT CODES, AND GIFT CARDS

Discount codes, promotional offers, free gifts, bundles, giveaways, and special pricing may be subject to eligibility restrictions and expiration dates.

Unless expressly stated otherwise:

  • Discount codes cannot be combined;
  • Discounts cannot be applied retroactively;
  • Offers have no cash value;
  • Offers may be limited to one per customer or household;
  • Promotional items may be excluded from returns; and
  • We may modify or discontinue an offer at any time before an eligible order is placed.

Gift cards are subject to the terms displayed at purchase and applicable law.

We reserve the right to cancel orders or promotions involving misuse, manipulation, unauthorized duplication, technical errors, or fraud.

The Services and their content, including our:

  • Logos;
  • Product names;

No intellectual-property rights are transferred to you by your use of the Services.

Shopify and third-party names, logos, and trademarks remain the property of their respective owners.

The Services may contain links to, integrations with, or tools supplied by third parties, including payment processors, shipping carriers, social platforms, analytics providers, and Shopify applications.

Third-party services are governed by their own terms and privacy policies.

We do not control and are not responsible for:

  • Third-party security practices;
  • Third-party products or services;
  • Third-party outages;
  • Third-party representations; or
  • Transactions conducted outside our Services.

Your use of third-party services is at your own risk and subject to the terms of those third parties.

Questions or disputes concerning a third-party product or service should ordinarily be directed to the applicable third party.


SECTION 11 — RELATIONSHIP WITH SHOPIFY

The Singhal Heritage House uses Shopify to provide its online store and related e-commerce functionality.

All sales made through our store are transactions directly between the customer and The Singhal Heritage House, not Shopify.

To the extent permitted by applicable law, Shopify is not responsible for:

  • Our products;
  • Our product descriptions;
  • Order fulfillment;
  • Customer service;
  • Returns or refunds;
  • Product performance;
  • Injuries or damages involving our products; or
  • Disputes between us and our customers.

Nothing in this section limits any responsibility Shopify may independently have under its own terms or applicable law.


SECTION 12 — PRIVACY AND DATA PROCESSING

Our collection and use of personal information are governed by our Privacy Policy.

Our website is hosted by Shopify. Shopify and other service providers may process personal information as necessary to provide payment processing, hosting, analytics, fraud prevention, marketing, customer service, and related services.

Information may be processed or stored in jurisdictions outside the customer’s place of residence, subject to applicable privacy laws and contractual protections.

Customers should review our Privacy Policy for information about:

  • Privacy rights; and

If you submit a review, image, video, testimonial, suggestion, idea, or other content to us, you represent that:

You grant us a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, edit, publish, translate, distribute, and display submitted content for business, advertising, promotional, and operational purposes.

This license does not transfer ownership of your content to us.

We may review, remove, reject, or decline to publish user content that violates these Terms or our policies.

We are not required to:

  • Keep feedback confidential;
  • Pay for unsolicited feedback; or
  • Respond to submitted feedback.

SECTION 14 — ERRORS, INACCURACIES, AND OMISSIONS

Occasionally, the Services may contain errors, inaccuracies, or omissions involving:

  • Availability;
  • Promotions;
  • Images;
  • Shipping charges;
  • Transit estimates;
  • Inventory; or
  • Other information.

We reserve the right to correct or update information and, where legally permitted, to cancel affected orders.

If payment has been collected for an order we cancel, we will issue an appropriate refund.

We are not obligated to update or amend information except where required by law.


SECTION 15 — PROHIBITED USES

You may not use the Services:

  • For unlawful, fraudulent, or malicious purposes;
  • To violate any law, regulation, ordinance, or third-party right;
  • To infringe intellectual-property or privacy rights;
  • To harass, threaten, abuse, impersonate, or defame another person;

  • Bypasses CAPTCHAs or security measures;
  • Ignores robots directives or technical restrictions;
  • Collects personal or proprietary information without authorization;
  • Disrupts website performance; or
  • Violates applicable law.

We may block or limit automated access at our discretion.

Normal indexing by legitimate search engines and authorized Shopify services is permitted subject to applicable technical instructions.

We may suspend or terminate your account or access to the Services if:

  • You violate these Terms;
  • We reasonably suspect fraud or misuse;
  • Continued access creates a security or legal risk;
  • Payment obligations remain unpaid; or
  • We discontinue all or part of the Services.

Termination does not eliminate obligations incurred before termination.

Provisions intended by their nature to survive termination will remain in effect, including provisions concerning intellectual property, payment obligations, disclaimers, limitations of liability, indemnification, governing law, and dispute resolution.


SECTION 18 — DISCLAIMER OF WARRANTIES

To the fullest extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis.

We do not guarantee that:

  • The Services will always be uninterrupted, secure, or error-free;
  • Product availability will remain unchanged;
  • Every error will be corrected immediately;
  • Website information will always be complete or current; or
  • Every product will meet a customer’s subjective expectations.

To the fullest extent permitted by law, we disclaim implied warranties, including warranties of merchantability, fitness for a particular purpose, title, durability, and non-infringement.

However, nothing in these Terms excludes or limits any warranty, consumer right, product-liability obligation, or remedy that cannot legally be excluded or limited.


SECTION 19 — LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, The Singhal Heritage House and its owners, officers, employees, contractors, agents, affiliates, and service providers will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from or relating to the Services or products.

This may include lost profits, lost revenue, lost business opportunity, loss of data, or replacement costs.

Where liability cannot legally be excluded, our liability will be limited only to the maximum extent permitted by applicable law.

Nothing in these Terms excludes or limits liability for:

  • Fraud;
  • Intentional misconduct;
  • Gross negligence, where it cannot be limited;
  • Personal injury caused by legally actionable product defects;
  • Breach of non-waivable consumer protections; or
  • Any liability that applicable law prohibits us from excluding.

SECTION 20 — INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless The Singhal Heritage House and its owners, officers, employees, contractors, agents, affiliates, and service providers from third-party claims, losses, liabilities, damages, and reasonable legal expenses arising from:

  • Your unlawful use of the Services;
  • Your material breach of these Terms;
  • Your violation of another person’s rights;
  • Content you submit; or
  • Fraudulent or unauthorized activity conducted through your account.

This obligation does not apply to claims caused solely by our own unlawful conduct, gross negligence, or intentional misconduct.


SECTION 21 — FORCE MAJEURE

We will not be liable for delay or failure caused by events reasonably beyond our control, including:

  • Natural disasters;
  • Severe weather;
  • Fire;
  • Flood;
  • Epidemics;
  • War;
  • Civil disturbance;
  • Government action;
  • Transportation interruption;
  • Carrier failure;
  • Labor dispute;
  • Utility outage;
  • Internet or telecommunications failure;
  • Cyberattack; or
  • Supplier interruption.

This section does not eliminate obligations that applicable consumer law requires us to perform, including applicable refund or shipping-delay obligations.


SECTION 22 — SEVERABILITY

If any provision of these Terms is found invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted or severed where necessary.

The remaining provisions will remain in effect.


SECTION 23 — WAIVER AND ENTIRE AGREEMENT

Our failure to enforce any provision of these Terms does not waive our right to enforce it later.

These Terms, together with our posted policies and any applicable order-specific terms, constitute the entire agreement between you and us regarding use of the Services and purchases from our website.

They replace prior communications or agreements concerning the same subject matter.


SECTION 24 — ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

We may assign or transfer our rights and obligations as part of a merger, acquisition, sale, reorganization, financing, or transfer of our business or assets, subject to applicable law.


SECTION 25 — GOVERNING LAW AND JURISDICTION

These Terms and any dispute arising from the Services will be governed by the laws of the State of Georgia, United States, without regard to conflict-of-law principles.

Subject to any mandatory consumer-protection or jurisdictional rights that apply, disputes may be brought in the state or federal courts having jurisdiction in or serving Clarke County, Georgia.

Nothing in this section prevents a consumer from exercising rights that cannot legally be waived in the consumer’s place of residence.


SECTION 26 — CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes in:

  • Our business practices;
  • Products or Services;
  • Technology;
  • Legal requirements; or
  • Shopify functionality.

The updated version will be posted on this page with a revised Last Updated date.

Material changes will be communicated where required by applicable law.

Changes will apply prospectively from their stated effective date and will not retroactively alter completed transactions unless legally permitted.
